Terms of Service

1. The Service

Velabuild builds custom web applications and prototypes based on the requirements you provide. We may add, change, or discontinue features at any time. Timelines, previews, and any estimates are provided in good faith but are not guarantees.

2. Eligibility & accounts

You must be at least 18 years old and able to form a binding contract. You are responsible for your account, for the accuracy of information you provide, and for all activity under your account and by teammates you invite.

3. Your content & licence to us

You retain ownership of the content, descriptions, and files you submit ("Your Content"). You grant Velabuild a worldwide, royalty-free licence to host, use, copy, and process Your Content solely to operate the Service and build and deliver what you request. You represent that you have the rights to submit Your Content and that it does not infringe any third party's rights or violate any law.

4. Our intellectual property

The Service, the Velabuild platform, boilerplate, tooling, templates, know-how, and all related intellectual property are and remain owned by Velabuild. Except for the delivered application built for you, nothing in these Terms transfers any of our intellectual property to you. We may reuse general skills, techniques, and non-client-specific components across engagements.

5. Acceptable use

You agree not to use the Service to:

• break the law or infringe others' rights;
• upload malicious code, or attempt to disrupt, probe, or gain unauthorized access;
• submit content that is unlawful, harmful, or that you lack the rights to submit;
• resell or misrepresent the Service.

6. Fees

The Service is currently offered free of charge during early access. We may introduce fees in the future; any paid features will be described before you incur a charge. Free access may be limited, changed, or withdrawn at any time.

7. Disclaimers

THE SERVICE AND ALL DELIVERABLES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. Velabuild does not warrant that the Service will be uninterrupted, error-free, or secure, or that any application will meet your requirements.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Velabuild AND ITS OWNERS, OPERATORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID TO US IN THE THREE (3) MONTHS BEFORE THE CLAIM, OR USD 100.

9. Indemnification

You will defend, indemnify, and hold harmless Velabuild and its owners and operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, or your breach of these Terms.

10. Suspension & termination

We may suspend or terminate your access at any time, with or without notice, including for any breach of these Terms. You may stop using the Service at any time. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.

11. Governing law

These Terms are governed by the laws of Thailand, without regard to conflict-of-laws rules, and the courts of Thailand will have exclusive jurisdiction over any dispute, unless mandatory local law provides otherwise.

12. Changes

We may update these Terms from time to time. Material changes will be posted here with an updated date; your continued use of the Service constitutes acceptance of the revised Terms.
